The Wayback Machine is an initiative of the Internet Archive , a 501(c)(3) non-profit, building a digital library of Internet sites and other cultural artifacts in digital form. Other projects include Open Library & archive-it.org .

The Wayback Machine cannot completely archive web pages that contain interactive features such as Flash platforms and forms written in JavaScript and progressive web applications, because those functions require interaction with the host website.

The Internet Archive said it "...has no interest in including materials in the Wayback Machine of persons who do not wish to have their Web content archived. We recognize that Ms. Shell has a valid and enforceable copyright in her Web site and we regret that the inclusion of her Web site in the Wayback Machine resulted in this litigation."
