    The Matrimonial Causes Act 1857 was the first divorce law of general application. The 1857 Act introduced divorce through the court. Men were able to “petition the court” for a divorce on the basis of their wife’s adultery, which would have to be proved, as would the absence of any collusion or condonation of that adultery.
    The 1857 Matrimonial Causes Act allowed ordinary people to divorce. Before then, divorce was largely open only to men, and had to be granted by an Act of Parliament, which was hugely expensive, and therefore was also open only to the rich.
    The Matrimonial Causes Act of 1857 gave women in England the ability to petition for divorce from their husbands, although women were held to a much higher burden of proof to show fault in the marriage than their male counterparts. Across the pond, divorce in the United States was no easier.
